Maintenance Agreement Terms and Conditions.
* All No Horsing Around Protection Memberships are 1 Year Contracts.
*Comprehensive Parts & Labor Coverage: This covers everything Inside the box of the HVAC Equipment including labor.
*Repairs and Diagnosis are to be performed by Roy Rogers Heating and Air employees.
*Platinum Comprehensive Parts & Labor Membership EXCLUSIONS are as follows, but may not be limited to:
TXV Valves(s)
Pistons
Filter Dryers
Reversing Valves
Refrigerant Leak Repairs
Air Filters
Back flow check valves
Batteries
Condensate pumps
Dehumidifiers
Disconnects
Drain lines
Ductwork and Grills
Energy Recovery Ventilation
External metal or plastic venting and all associated parts
External drain tubing and all associated parts
External line/low voltage wiring
Firebox/combustion chamber
Fuses and Circuit Breakers
Humidifiers
Humidistat
Nitrogen isolation tests to locate a refrigerant leak
Surge Protection Devices
Zoning and air cleaners, and any parts added on to Your Equipment to accommodate ancillary equipment.
The Plan will not cover:
Equipment or components not specifically listed in this Agreement;
The cost for diagnosis or labor if the system problem is due to an improper thermostat setting; an extinguished pilot light; blown fuse; or if the Equipment has been turned off;
Services required subsequent to Our advisement that You perform certain repairs to ensure Your Equipment is in good working order;
Electronic, computerized or energy management or monitoring systems or devices, such as “Smart House”;
Service necessitated by any loss or damage resulting from any cause other than normal usage;
Damage to the Equipment due to chemical or sedimentary build-up, misuse or abuse, unauthorized repair by others, failure to clean or maintain the Equipment, rust, corrosion, insect infestation, mold, mildew or bacterial manifestations, missing parts, structural change, fire, freezing, electrical failure or surge, water damage, lightning, mud, earthquake, soil movement, windstorms, hail, theft, negligence, intentional acts, riot, accidents, pet or pest damage, acts of God, or failure due to excessive water pressure or any other perils are not considered loss or damage by normal use;
Upgrades or the cost of construction, carpentry, or other modifications necessary to access existing Equipment or install new Equipment;
The replacement or restoration of wall coverings, drywall, plaster, wallpaper, paint, floor coverings, tile, cabinetry, counter tops, landscaping or other similar items in the home or the repair of any structural or cosmetic defects as a result of the Services;
Preventative maintenance, unless covered by the Plan You selected as identified on Your Order Confirmation;
Consumable items, including but not limited to filters and fuses; and
Refrigerant.
If a Member cancels their reoccurring monthly payments and/or fails to pay their membership in full prior to the expiration of the membership they will be responsible to pay back all discounts received within 7 days! Failure to pay back discounts may result in penalties such as 2% Late Fee for each week after the initial 7 day period.
*New system credit applies to the installation of a new HVAC system that is purchased and installed by Roy Rogers Heating and Air. Customer must maintain a Gold Membership for credits to accrue and/or be used.
*New Business Referral program applies to any new client you refer to us and they must purchase any service we offer. Customer must maintain a We're Not Horsing Around Club Membership for credits to accrue and/or be used. If customer allows plan/plans to expire the customer forfeits any credits accrued.
* If a current member sells a home with a club membership attached it can be transferred to the new Home Owner at their expense. If member is paying monthly payments the new homeowner may call in to retain the agreement otherwise the agreement ends at that time with all sales final.
*Members will receive reminders for scheduling, however, the member is responsible to call in and schedule. No refunds will be issued for any missed maintenance visits.
*Member will receive a reminder to renew or cancel 1 month prior to expiration date.
*All No Horsing Around Protection Memberships are 1 Year Contracts.
3.New Installations. Once a customer customer accepts an estimate for work that acts as a binding contract between Roy Rogers Heating and Air, LLC, and the customer on the estimate. Upon acceptance of an estimate and down payment if required, Roy Rogers Heating and Air will initiate scheduling and complete the work agreed upon. Once work is completed Payment in Full is Due.
4.Warranty on New Systems. If your system is purchased through Roy Rogers Heating and Air has an extended Limited Parts & Labor Warranty you the purchaser will be required to maintain at a minimum a Bronze No Horsing Around Protection Membership. You must maintain this membership to Keep all labor warranties valid. The manufacture requires regular maintenance be done 2 times per year to your system to keep parts warranty valid. Therefore the Bronze Membership will satisfy both of these Limited Warranties requirements.
